The short answer is no — Texas law does not require you to use a licensed real estate agent to sell your home. The more complete answer is what sellers who go it alone tend to discover about halfway through the process.

What Texas Law Actually Requires

In Texas, a homeowner may sell their own property without a licensed real estate agent under the For Sale By Owner (FSBO) model. However, the transaction itself still requires the use of a title company to conduct the title search, hold escrow, and handle the closing. Most buyers purchasing a FSBO property will use their own buyer's agent — meaning the seller will likely need to cooperate with and compensate a buyer's agent even without a listing agent on their side. The TREC-promulgated contract forms remain the standard even in FSBO transactions, and any buyer's agent will submit an offer using those forms regardless of the seller's representation status.

What the Data Shows on FSBO Sales

The National Association of Realtors' 2025 Profile of Home Buyers and Sellers found that FSBO homes sold for a median of $380,000, compared to $435,000 for agent-assisted homes — a difference of $55,000. FSBO sellers who knew their buyer personally — a neighbor, friend, or family member — accounted for a significant share of that category, meaning the price gap on truly open-market FSBO sales may be even larger. The most common challenges reported by FSBO sellers included setting the right price, preparing and fixing the home for sale, attracting potential buyers, and understanding and completing the required paperwork.

What a Listing Agent Actually Does

A professional listing agent's value is most visible in three areas: pricing, marketing, and negotiation. An agent who knows the Boerne and Kendall County market prepares a comparative market analysis grounded in recent local comparable sales — not just a Zillow estimate — and positions the home correctly within the active competition. Active marketing goes well beyond MLS entry: professional photography, agent network outreach, social media, open houses, and targeted digital advertising all drive buyer exposure. And in contract negotiations, an experienced listing agent knows how to protect the seller's position on price, concessions, inspection requests, and contract amendments.

The Current Market Context

In the current Texas market with approximately five months of statewide inventory as of Q1 2026 per the Texas Real Estate Research Center, sellers are competing against more options than at any point since before the pandemic. Buyers have choices and time. A FSBO listing that lacks professional photography, MLS presence through a cooperating agent, and active marketing is competing against professionally marketed listings at a meaningful disadvantage — in a market where that disadvantage already exists due to elevated supply.
